Terms & Conditions for The Wacky Photo Booth

Please read these Terms & Conditions carefully before booking services with The Wacky Photo Booth. By accessing our website or hiring us for an event, you agree to the following terms, policies, and responsibilities.

These terms apply to all services provided by The Wacky Photo Booth, including open-air photo booth rentals, event photography, custom props, printing services, and digital delivery.


1. Booking & Reservation

1.1 Booking Confirmation

A date is considered reserved only when:

  • A signed agreement (digital or written) is received, and

  • A non-refundable retainer (amount determined in your package) is paid.

Until these steps are completed, your event date may be booked by another client.

1.2 Remaining Balance

The remaining balance is due:

  • 7 days before the event, unless otherwise agreed in writing.
    Unpaid balances may result in cancellation of services.


2. Payments

We accept:
✔ Credit/debit cards
✔ PayPal
✔ Zelle
✔ Cash (if arranged in advance)

2.1 Non-Refundable Retainer

Retainers secure your event date and cover administrative, scheduling, and preparation time. Retainers are non-refundable under all circumstances.

2.2 Late Payments

Late payments may delay delivery of digital files and/or cancel service at the event.


3. Cancellation & Rescheduling

3.1 Client Cancellation

If you cancel for any reason:

  • The retainer is non-refundable

  • If cancellation occurs within 7 days of the event, the full contract balance is due

3.2 Rescheduling

We allow one complimentary date change based on availability. If the new date is unavailable, the booking will be considered cancelled.

3.3 Cancellation by The Wacky Photo Booth

In the rare event we must cancel due to emergency, illness, or equipment failure:

  • You will receive a full refund, including your retainer

  • We will make reasonable efforts to refer you to a trusted partner

We are not responsible for any additional costs incurred by the client.


4. Event Requirements & Client Responsibilities

4.1 Space Requirements

For optimal performance, we require:

  • A 10 ft x 10 ft area

  • Access to one (1) electrical outlet

  • A flat, dry, indoor or covered outdoor space

Outdoor events must provide adequate shade, shelter, and protection from weather.

4.2 Access & Setup

We typically arrive 45–60 minutes before the event for setup.
Clients must ensure:

  • Easy unloading/loading access

  • Early venue entry

  • Parking availability

4.3 Props & Equipment

Clients are responsible for:

  • Ensuring props are used respectfully

  • Preventing damage by guests (children included)

Any lost or damaged props may result in replacement fees.


5. Photography Rights & Usage

5.1 Guest Participation

By participating in the photo booth, guests acknowledge they may be photographed.

5.2 Copyright

All images taken by The Wacky Photo Booth are protected under U.S. Copyright Law.

5.3 Client Usage Rights

Clients receive a personal-use license to:

  • Share images on social media

  • Print photos for personal use

  • Use images for event-related purposes

Clients may not sell, alter, or redistribute images commercially without written consent.

5.4 Business Marketing Use

We may use booth images (not sensitive or embarrassing) for:

  • Website portfolio

  • Social media

  • Advertising & promotional materials

If you prefer no images be shared publicly, please inform us in writing before the event.


6. Technical Issues & Event Conditions

6.1 Equipment Malfunction

If equipment fails and cannot be repaired on-site:

  • A partial or full refund may be issued based on the portion of time affected

  • No further damages or compensation shall be required beyond the refund

6.2 Delays

We are not responsible for delays caused by:

  • Venue access issues

  • Weather conditions

  • Guest interference

  • Power outages

Lost time due to these issues is not refundable.

6.3 Extreme Conditions

We reserve the right to pause or discontinue service if:

  • Weather conditions threaten equipment

  • Guests are acting in a dangerous or destructive manner

  • The environment is unsafe


7. Conduct & Safety

The Wacky Photo Booth promotes a fun, respectful, and family-friendly environment.

We reserve the right to refuse service to individuals engaging in:

  • Harassment

  • Aggressive behavior

  • Dangerous actions

  • Excessive intoxication

If inappropriate behavior jeopardizes staff safety, we may shut down the booth with no refund.


8. Delivery of Digital Files

8.1 Delivery Timeline

Digital galleries are typically delivered within:

  • 3–5 business days for photo booth events

  • 7–10 business days for events with additional photography services

8.2 File Storage

We store images for 30 days after delivery.
Please download and back up your images promptly.


9. Limitation of Liability

To the maximum extent allowed by law, The Wacky Photo Booth is not liable for:

  • Accidental injury of guests

  • Venue damages unrelated to our equipment

  • Loss of digital files due to circumstances beyond our control

  • Failure to perform due to events outside our control (weather, emergencies, etc.)

Our total liability shall not exceed the amount paid for the contracted services.


10. Changes to These Terms

We may revise these Terms & Conditions at any time. Updates will be posted on this page with a new “Last Updated” date.
